Conditions of Sale

 

  1. General provisions 

1.1.  These general conditions of sale (hereinafter, “General Conditions”) apply to all sales of Patty Q’s Jewelry Inc. products (hereinafter, “Products” or “Product”) carried out through the https://pattyqsjewelry.com/ website (hereinafter, “Website”). 

1.2.  Selling of Products -regulated under these General Conditions- is only available to consumers over the age of eighteen (18) years (or the age of majority of the individual's relevant country) (hereinafter, “Clients” or “Client”) being natural persons that obtain Products for personal, family, or household purposes. Client is prohibited from purchasing any Product from the Website for purposes of resale by you or any other person, and Patty Q’s Jewelry Inc. expressly disclaims any warranty or claim for damages, consequential or otherwise, resulting from Client's intent or attempt to resell any Product purchased from the Website. 

1.3.  The language of any contract of sale through this Website shall be English. 

1.4.  Clients are required to carefully read these General Conditions, which are available on the Website to enable Clients to acknowledge, store and reproduce them. Contracts of sale executed with the Clients will be archived by Patty Q's Jewelry Inc for the retention period required by applicable law.

 

  1. Identification of the vendor 

2.1.  The vendor is Patty Q’s Jewelry Inc., with a registered office at 608 S Hill, P202, Los Angeles, CA 90014 (“Patty Q’s Jewelry”).

 

 

  1. Information on Products and Their Availability

3.1. The Website provides information on Products, including their relevant Product codes and prices. Patty Q's Jewelry Inc reserves the right to make adjustments to the pricing, descriptions, or features of Products for various reasons, such as changing market conditions, Product discontinuation, material unavailability, changes to manufacturing processes, and errors in advertisements.

3.2. The Products available on the Website represent a selection of items normally found in store; however, Patty Q’s Jewelry does not warrant the availability of the Products in the physical store that are also available on the Website. While the photographs and images of Products displayed on the Website and Services (as defined in the Website Terms of Use) aim to portray them as accurately as possible, the accuracy of colors may be affected by the settings and specifications of the Client's viewing device or display. Due to the handmade nature and customization of our items, there may be slight variations or differences in certain details from the photographs displayed on our website. While we make every effort to portray the products as accurately as possible in the photographs, these variations are inherent in the manufacturing process and contribute to the uniqueness and charm of each item. The information provided on the Website and/or Services should not be the sole basis for making decisions without consulting more accurate, complete, or timely sources of information.

3.3. Patty Q’s Jewelry reserves the right to limit the quantities and/or types of Products available on the Website at any time. The style, models, and colors of the Products described on the Website may be subject to change without notice. During the purchase process, if the ordered Product is unavailable, the Client will receive a response informing them that the order cannot be processed.

3.4. Patty Q’s Jewelry shall not be held liable for errors that occur due to a failure of the Client's connection to the Website.

 

 

 

  1. Price

4.1. The prices of the Products listed on the Website are denoted in U.S. Dollars and do not include applicable taxes or surcharges. Patty Q’s Jewelry is required to charge state, local, and county taxes on online transactions as per applicable laws. Please note that the on-screen transaction total reflects an estimated tax amount. The actual sales tax will be calculated and applied when your order is shipped, and it may vary from the estimated tax. If you place an online order in-store using cash as the payment method, sales tax will be charged at the time of purchase based on the shipping address. Additionally, delivery costs will be added to the price of the Products.

4.2. Patty Q’s Jewelry takes regular measures to ensure that the prices displayed on the Website for the Products are accurate; however, errors may occur. If a Product is listed at an incorrect price, Patty Q’s Jewelry reserves the right to refuse or cancel orders for that Product prior to delivery, regardless of whether the order has been confirmed or payment has been made. In such cases, Patty Q’s Jewelry will provide the Client with the option to purchase the Product at the correct price.

 

  1. Execution of the Contract

5.1. The essential characteristics and prices of each Product are displayed on the Website. The information provided on the Website does not constitute an invitation to treat by Patty Q's Jewelry.

5.2. Prior to submitting an order through the Website, the Client must carefully read all the instructions provided during the purchase process, including information regarding delivery charges, the return policy, and the privacy policy statement, in addition to these General Conditions.

5.3. To purchase a Product, the Client must: (i) add the selected Product to the "Shopping Bag" by clicking the appropriate button, (ii) complete the order proposal, (iii) choose the payment method, (iv) accept the General Conditions, and (v) send the order proposal to Patty Q's Jewelry through the Website.

5.4. Sending the order constitutes a binding offer by the Client to purchase the selected Product, subject to these General Conditions (excluding the return policy outlined in Section 10). By sending the order proposal, the Client commits to paying the price of the ordered Product(s) if the order is accepted and confirmed by Patty Q's Jewelry.

5.5. Any errors or changes in the data entered by the Client in the order proposal can be corrected by the Client using the process described on the Website before submitting the order proposal (e.g., modifying the quantity of Products by adding or removing items from the "Shopping Bag").

5.6. In compliance with the Privacy Policy statement, the order proposal and the Client's data related to the order may be retained by Patty Q's Jewelry for the period required by applicable laws. Based on Patty Q's Jewelry's legitimate interest, personal data provided by the Client as a Guest for making a purchase may be used to classify Guest profiles, including purchase amount, frequency, number and type of products purchased, country of billing and shipping, and returns made.

5.7. Patty Q's Jewelry reserves the right to refuse an order proposal at its sole discretion before accepting and confirming the order. This includes circumstances such as: (i) unavailability of Products (excluding the provision under Sections 3.3 and 5.9); (ii) suspected fraudulent or illegal activities, including purchases for resale or commercial purposes; or (iii) the Client's failure to fulfill obligations under a previous contract with Patty Q's Jewelry.

5.8. The contract between Patty Q's Jewelry and the Client is formed when the Client receives the acceptance and confirmation of the order proposal from Patty Q's Jewelry via email ("Order Confirmation").

5.9. If one or more of the ordered Products are unavailable, the Client will receive an email notifying them of the unavailability. In such cases, the order proposal will be canceled or partially accepted for the available Products only. If the order is partially accepted, the Client will be charged only for the price of the available Products.

5.10. The Order Confirmation will include a summary of the essential characteristics of the purchased Products, a detailed indication of the price and payment methods, information on delivery charges, details about exercising the right of withdrawal (including the return policy), the address for submitting complaints, information on support services, and the applicable commercial terms. Title to the Products and the risk of loss or damage during shipment pass from Patty Q's Jewelry to the Client upon delivery to the destination specified by the Client (F.O.B. Destination, freight prepaid and added).

 

  1. Method of Payment

6.1. Payment for the Products, including the applicable taxes, fees, and delivery charges, must be made by the Client using a credit card, Klarna, Shop Pay, cash (for in-store purchases on Patty Q's Jewelry website only), or other acceptable methods as deemed appropriate by Patty Q's Jewelry.

6.2. Patty Q's Jewelry currently accepts the following payment methods:

Shop Pay

Cash (for in-store Patty Q's Jewelry website purchases only)

6.3. The Client's selected form of payment will be charged for the transaction only after the following conditions have been met:

(i) Verification of the payment method.

(ii) Receipt of authorization to charge the payment method from the issuer or processor.

(iii) Confirmation of Product availability by Patty Q's Jewelry.

(iv) Readiness to ship the order, unless the order includes Custom Product(s) designed or customized to the Client's specifications. In such cases, the transaction for such Product(s) will be charged after completing steps (i) - (ii) above or when the order is placed in store using cash as the payment type. Section 6.7 below will apply in the latter case.

Orders for items available for immediate purchase cannot be canceled or modified once they have been placed. If you wish to return your item, please refer to our returns and exchange section. Pre-orders and back-orders that have not yet shipped can be canceled by contacting us. Custom Order and personalized items, cannot be canceled or modified. These items are considered final sale and cannot be returned.

6.4. If, for any reason, it is impossible to charge the amount due from the Client prior to accepting and confirming the order, the contract will not be executed, and the order will be canceled.

6.5. The use of Klarna as a payment method is subject to a credit check and approval and may be ineligible for certain product categories. A down payment may be required. Payment options may vary based on your purchase. For more information, please visit https://www.klarna.com/us/customer-service/.

6.6. Orders placed in-store using cash as the payment type must be paid in full at the time of ordering.

 

  1. Transport and Delivery

7.1. Patty Q's Jewelry will deliver the Products to the address specified by the Client in the order proposal. A signature from the Client or a nominated adult representative is required upon delivery. Please note that purchases cannot be shipped to P.O. boxes, APO/FPO addresses, or addresses outside the continental United States, Alaska, Hawaii. After the parcel is handed over to our designated mail carrier, USPS, Patty Q's Jewelry relinquishes responsibility for any loss, damage, or delay during transit. Please be aware that Patty Q's Jewelry cannot be held liable for missing packages marked as delivered. If you suspect a misdelivery, we advise filing a claim directly with the carrier. Additionally, we do not offer reshipment or exchanges at this time; a new order must be placed with refunded funds from the returned package. Additionally, Patty Q's Jewelry cannot be held responsible for unforeseen delivery delays beyond its control.

7.2. For each order, Patty Q's Jewelry will issue an invoice to the Client by email or mail, in accordance with applicable laws and regulations. The invoice will be based on the information provided by the Client at the time of the order. Once the invoice has been issued, no alterations can be made to it.

7.3. Unless otherwise specified by Patty Q's Jewelry, the Client shall bear the delivery charges, which will be indicated separately on the order form and invoice.

7.4. All orders are processed from Monday to Friday, excluding Saturdays, Sundays, and holidays. To estimate the total delivery time for a purchase, please allow up to four  business days from the order date for order processing and shipment, unless Product is Custom, please allow up to three weeks, in addition to the time required by the Client's preferred shipping method.

7.5. The purchased Product(s) will be delivered by a carrier selected by Patty Q's Jewelry, referred to as the "Carrier." Ground deliveries are made from Tuesday to Saturday, excluding Sundays and holidays.

7.6. Unless otherwise specified in the Order Confirmation, the purchased Product(s) from Patty Q's Jewelry will be delivered within 30 (thirty) days from the date of the Order Confirmation, except in the case of a force majeure event or unforeseeable circumstance. If the delivery has not occurred within the specified timeframe, the Client (by sending an email to pattyqsjewelry@gmail.com) shall provide Patty Q's Jewelry with an additional ten (10) days to deliver the Product. However, if Patty Q's Jewelry fails to comply with the specified timeframe after receiving the notice, the Client's remedies shall be limited to terminating the contract and receiving a refund of the payment made.

7.7. Upon delivery of the Products by the Carrier, the Client (or a nominated adult representative) is required to verify the following:

(i) The number of items being delivered matches the quantity indicated in the shipping confirmation email.

(ii) The packaging and its seals are intact, undamaged, not wet, or altered in any way.

Any damages to the packaging and/or the Product, or any discrepancies in the number of items or documentation, must be immediately documented in writing on the Carrier's delivery receipt. Unless permitted by applicable laws, once the Client has signed the Carrier's delivery receipt without raising any objections, the Client may not make any further objections regarding the external characteristics of the delivered parcel.

 

  1. Shipping and delivery confirmation 

8.1.  Patty Q’s Jewelry shall send to the Client a Shipping Confirmation via e-mail once the Products are dispatched and a further e-mail once the Products have been delivered.

 

  1. Wrapping or packaging 

9.1.  Products purchased from the Website are delivered with the same Patty Q’s Jewelry standard packaging as provided in Patty Q’s Jewelry store.

 

 

  1. Personalized and Made-to-Order Products 

10.1. To the maximum extent permissible by applicable law and in accordance with applicable laws in the United States governing the purchase and sale of special goods made to order, withdrawals, cancellations, exchanges or returns are not accepted for orders of customized products such as, for example, those with the Client’s initials engraved on the Product, or Custom products such as, for example, certain items and other products designed or customized to the Client’s specifications. The Client is advised that images, photographs and samples of the engraving on personalized Products and other customized elements may differ from the appearance of the actual Product.

10.2. For jewelry items undergoing resizing or adjustments (including ring resizing, bracelet, chain, or anklet cutting for sizing), clients may cancel their order within 10 minutes from the start of service.

Upon cancellation within this period:

A refund will be issued for the total amount, minus a 10% labor and restocking fee.


After the 10-minute window, cancellations will no longer be accepted, and the order will proceed as agreed.
 

  1. Exchanges

11.1. If for any reason you are not completely satisfied with your purchase, our return policy can be granted of store-credit/exchange within 10 days after the delivery or pick up date under the following circumstances:

To be eligible for store-credit/exchange, your item(s) must be untampered with, altered or damaged and in the same condition that you received it. It must also be in the original packaging.

Once we receive your item, we will fully inspect and notify you on the status of your refund.

If the refund is eligible, client will receive store credit in-store or online which does NOT include shipping costs.

You will receive an email notification once your return is processed. Please allow up to 5 additional business days for the funds to be credited to your original payment method.

  1. Warranty

12.1.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL PRODUCTS SOLD THROUGH THE WEBSITE ARE SOLD "AS IS" WITH NO WARRANTIES. Client acknowledges that no employee of Patty Q's Jewelry or its affiliates is authorized to make any representation or warranty on behalf of Patty Q's Jewelry or any of its affiliates that is not stated in these Conditions. Patty Q's Jewelry also makes no warranties to the Client regarding the applicability of all laws and regulations affecting, including but not limited to the manufacture, performance, sale, packaging, and labeling of the Products within the Client's territory.

 

  1. Limitation of Liability

13.1 We do not guarantee, represent or warrant that Client’s  use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. Client agrees that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to Client. Client expressly agrees that use of, or inability to use, the service is at their sole risk. The service and all products and services delivered to Client through the service are (except as expressly stated by us) provided 'as is' and 'as available' for their use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. In no case shall Patty Q's Jewelry, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
